Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Vanikar LLC (“Vanikar,” “we,” “us,” or “our”). They govern the website at vanikar.games (the “Site”) and the Card Games by Vanikar mobile application (the “App”), together the “Services.” By using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old (16 where local law sets that age) to use the Services. If you are under 18, a parent or legal guardian must review and agree to these Terms on your behalf and is responsible for your use.

2. Your Account

Playing against the computer does not require an account. Online play, friends, leaderboards, statistics and Premium do. When you register you agree to give accurate information and keep it current. Keep your password private: you are responsible for everything done through your account, and you must tell us at info@vanikar.com if you think someone else has used it. One account per person; accounts may not be sold, shared or transferred.

3. Licence

Vanikar grants you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, and to view the Site, for your own non-commercial entertainment. The App is licensed, not sold. All rights not expressly granted are reserved.

4. Free Trial, Free Games and Premium

Free trial

When you first open the App you receive a 14-day trial of everything in Premium. No payment method is needed and nothing is charged when it ends. The trial is available once per person.

Free games

After the trial you may choose any three games to keep at no cost. Free games are playable offline against the computer only. The choice is one-time and permanent for that account: it cannot be changed later, so use the trial to decide. Subscribing to Premium unlocks every game without affecting your three free games.

Premium subscription

  • Premium is an auto-renewing subscription, monthly or yearly, sold by the Apple App Store or Google Play. Prices are shown in the store before you buy and may vary by country.
  • Your subscription renews automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Cancel in your App Store or Google Play subscription settings; the App’s “Manage subscription” button takes you there. Cancelling stops future renewals; you keep Premium until the paid period ends.
  • Payments are final except where the store’s refund policy or applicable law provides otherwise. Refund requests go to the store, not to us. We cannot issue refunds for store purchases.
  • Premium is tied to your Vanikar account, not your device. Use “Restore purchases” after reinstalling or changing phones. A subscription is managed on the platform where it was bought.
  • If we raise the price, the store will tell you in advance and, where required, ask you to agree before the new price applies.
  • If your subscription lapses you return to the free tier: your three free games, offline. Your statistics, achievements and friends are kept and reappear if you resubscribe.

Founder price lock

Subscribers who start a yearly subscription during the Founder period announced on the Site receive a price lock: the yearly price you first pay is held for three years from your first subscription date, provided your subscription remains continuously active. The lock ends if the subscription is cancelled, lapses, or is refunded; a later subscription is at the then-current price. Store currency conversions and taxes are outside the lock. We may end the Founder offer for new subscribers at any time without affecting locks already granted.

Coming-soon features

Features and games marked “coming soon” on the Site or in the App are in development. We aim to include them in Premium when they ship, but they are not part of what you are buying today, and their scope and timing may change. Please do not subscribe on the strength of a feature that has not been released.

5. Rules of Conduct

You agree not to:

  • Cheat, collude with other players, or use bots, automation, modified clients, or any tool that gives an unfair advantage.
  • Exploit a bug rather than reporting it to info@vanikar.com.
  • Harass, threaten, bully or intimidate anyone, in voice chat or anywhere else in the Services.
  • Use hate speech, sexual, violent or otherwise offensive content in your display name, avatar, voice chat or messages.
  • Impersonate another person, or misrepresent your connection with Vanikar.
  • Collect, record or share other players’ personal information or voice without their consent.
  • Post invite codes for private tables in public places if the host has not asked you to.
  • Buy, sell, trade or transfer accounts or subscriptions.
  • Reverse engineer, decompile, scrape, or interfere with the App, the Site or our servers, or access them by any means other than the interfaces we provide.
  • Use the Services for gambling, for anything unlawful, or in breach of App Store or Google Play rules.

Games in the App are played for points and rankings only. No real money, prizes or anything of value can be won or wagered.

6. Your Content

You keep ownership of your display name, avatar and anything else you contribute (“Your Content”). You grant Vanikar a worldwide, non-exclusive, royalty-free licence to store, display and transmit Your Content as needed to run the Services, including showing it to other players and on leaderboards. You are responsible for Your Content and confirm you have the rights to use it. We may remove or replace any content that we believe breaches these Terms, without notice.

7. Voice Chat and Discord

Voice chat at the table is provided by Discord: your audio travels over Discord’s service, not ours, and we neither record it nor can moderate it in real time. Report abuse to us and use the mute controls. Voice, account linking, presence, invitations and community servers are optional Discord features and are also subject to Discord’s own Terms of Service and community guidelines. Vanikar does not operate Discord and is not responsible for it.

8. Leaderboards, Clubs and Tournaments

Rankings are calculated by rules we set and may change; seasonal rankings reset on a schedule we announce. We may remove or adjust results obtained through cheating or in breach of these Terms. When clubs and tournaments are offered, club founders are responsible for moderating their clubs in line with these Terms, and event-specific rules will apply in addition to them.

9. Changes to the Services

We add, change and occasionally retire games and features. We may modify or discontinue any part of the Services, temporarily or permanently, with reasonable notice where practical. If a game you chose as one of your three free games is retired, you may choose a replacement. If we discontinue the App entirely, we will give you at least 30 days’ notice so you can cancel any subscription before it renews.

10. Intellectual Property

The Services, including software, artwork, card designs, game presentations, text and trademarks, are owned by Vanikar or its licensors and protected by copyright and trademark law. The traditional card games themselves are not ours to own; our implementations, rules texts and designs are. You may not copy, modify, distribute, sell or lease any part of the Services without our written permission. Apple, App Store, Google Play and Discord are trademarks of their respective owners.

Our Privacy Policy explains what we collect and why, and is part of these Terms.

12. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, VANIKAR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF OTHER PLAYERS’ MISCONDUCT.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VANIKAR AND ITS OFFICERS, MEMBERS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROGRESS OR STATISTICS, ARISING FROM THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100. Some jurisdictions do not allow these limits; in that case they apply only as far as the law permits.

14. Indemnification

You will defend and hold harmless Vanikar and its officers, members and agents from claims, losses and expenses (including reasonable legal fees) arising from Your Content, your use of the Services, or your breach of these Terms.

15. Termination

You may stop using the Services at any time and may delete your account in the App or by emailing us from the address on the account. We may suspend or terminate your account if you breach these Terms, if required by law, or if we discontinue the Services. Termination for breach does not entitle you to a refund. Sections 6, 10 and 12 to 18 survive termination.

16. App Store Terms

If you got the App from the Apple App Store: these Terms are between you and Vanikar, not Apple; Apple has no obligation to provide maintenance or support; if the App fails to conform to a warranty you may notify Apple for a refund of the purchase price, and Apple has no other warranty obligation; Apple is not responsible for any claims relating to the App, including product-liability, legal-compliance or consumer-protection claims, or for third-party intellectual-property claims; you confirm you are not in a country subject to a U.S. government embargo or on any U.S. restricted-parties list; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. If you got the App from Google Play, the Google Play Terms of Service also apply.

17. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law rules. Before starting a formal dispute, email us at info@vanikar.com and we will try to resolve it informally within 30 days. If that fails, any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring individual claims in small-claims court. You and Vanikar each waive the right to a jury trial and to participate in a class action. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms. Nothing in this section limits rights you have under the mandatory consumer-protection laws of the country where you live; if you are a consumer in the EEA or UK, you may also bring claims in your local courts.

18. General

These Terms and the Privacy Policy are the whole agreement between you and Vanikar about the Services. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver of it. You may not assign these Terms; we may assign them to a successor of our business. Where a translation of these Terms differs from the English version, the English version controls.

19. Changes to These Terms

We may update these Terms. For material changes we will notify you in the App or by email at least 14 days before they take effect. Continuing to use the Services after that date means you accept the new Terms; if you do not, stop using the Services and cancel any subscription.
